4 PROCESS AND PRODUCT QUALITY& ENVIRONMENT
4.1 Quality Responsibility
SUPPLIER shall be responsible for and warrant the quality of the Products delivered to BUYER in compliance with the Specifications for manufacturing, testing, handling and packaging of the Product as referred to in the Product Purchase Agreement for the Products. For Products designed by SUPPLIER, this requirement shall also apply for the design.
4.2 Environment Responsibility
SUPPLIER shall comply with all local and international laws, regulations with respect to environment requirements. In addition, when manufacturing electrical and electronic products, Directive 2011/65/EC regarding the Restriction on the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (“RoHS”) must also be observed. And, certain obligations concerning labelling and reporting requirements for electrical and electronic equipment must be met according to Directive 2011/65/EC on waste electrical and electronic equipment (“WEEE”), which aims at the diminution of waste from electrical and electronic equipment, re-use, and substantial as well as ulterior utilization of such waste to reduce the amount of waste and to diminish the entry of pollutants into the waste; Furthermore, compliance EU Regulation REACH (EC) No 1907/2006, regarding Registration, Evaluation, Authorisation and Restriction of Chemicals.
Supplier guarantees that the Contract Products do not contain any banned materials listed in Salcomp substances list or substance in a concentration exceeding the limits set down in GWI 4-11 Salcomp Hazardous Substances management standard.
Supplier furthermore undertakes to inform Salcomp without undue delay in writing following the receipt of an order for Contract Products if the Contract Products contain one or more substances in a concentration which exceeds the limits set down in Salcomp Hazardous Substances management standard. Upon request by Salcomp, Supplier shall provide information on the presence of further substances in the Contract Products.
Salcomp is entitled to unilaterally make amendments of Salcomp Substances List if such amendments are based on changes in the pertinent local law or international law regulations. Further amendments shall only be possible upon mutual agreement.
This Agreement supplements all contracts between the Parties whose subject matter concerns the delivery of Contract Products. In the event of discrepancies between the provisions of those contracts and the provisions of this Agreement, the provisions of this Agreement shall prevail with respect to the subject matter of this Agreement.
4.3 Component Quality Plan and Specifications SUPPLIER shall produce and maintain a Component Quality Plan if required. SUPPLIER agrees at all times to design, manufacture, inspect and test the Product in accordance with the requirements
